The Role of Nationality in Solving Problems of Conflict of Laws in Matters of Personal Status (Marriage and its Dissolution as a Model)

Abstract

If a person's individual status belongs to them alone, family status encompasses their ties with others, as reflected in purely family relations. The marital bond is considered one of the broadest legal relationships open to conflict of laws, given that legal systems differ greatly in their views on it. Among the conclusions drawn is that the Algerian legislator, as a general rule, has subjected matters of the conclusion of the marital bond and its dissolution to the law of nationality. Accordingly, questions arise regarding the role assigned to this connecting factor and the exceptions applicable to it.
